TERMS AND CONDITIONS OF THE "Bathroom Days at Mexen" PROMOTION

I. PRELIMINARY PROVISIONS

  1. These Terms and Conditions define the rules of the promotion named "Bathroom Days at Mexen", hereinafter referred to as the "Promotion".
  2. The Organizer of the Promotion is:

    hereinafter referred to as the "Organizer".
  3. The Promotion is valid in the online store operated at:
    Mexen – www.mexen.ie
  4. The Promotion is valid from April 6, 2026, 00:00 until April 19, 2026, 23:59:59 or until stocks last (hereinafter: "Promotion Period").
  5. A condition for participating in the Promotion is to read and accept these Terms and Conditions. By participating in the Promotion, the Participant is deemed to have accepted these Terms and Conditions.
  6. A participant in the promotion is any customer of the mexen.ie store making purchases of Promotional Products in the mexen.ie store during the Promotion Period.
  7. A Customer is an entity making a purchase of a Product via the Online Store, concluding a Sales Agreement, who has legal capacity to effectively perform a specific action within the Online Store. A Consumer is a natural person performing a legal act with an entrepreneur that is not directly related to their business or professional activity. An Entrepreneur is a Customer, not being a Consumer, who enters into a Sales Agreement with the Seller for a purpose directly or indirectly related to their business or professional activity.
  8. This promotion is not a lottery or a mutual wager, the outcome of which depends on chance (drawing), within the meaning of relevant gambling laws.

II. DETAILED PROMOTION CONDITIONS

  1. The Promotion applies to the purchase of products in the Mexen store marked on the product page with the information: “Bathroom Days” (hereinafter: “Promotional Products”), which are exclusively found in the BATHROOM category, available at: https://mexen.ie/lazienka
  2. All promotional products during the Promotion Period will be placed on the Mexen store website at the URL: https://mexen.ie/lazienka
  3. The Promotion consists of the following: any person who, during the Promotion Period, makes a purchase of Promotional Products in a single order in the mexen.ie online store, with a quantity of at least 2 items, will receive a discount of:
    1. 10% off the price of the cheapest Promotional Product in the order, if the order contains exactly 2 Promotional Products,
    2. 20% off the price of the cheapest Promotional Product in the order, if the order contains exactly 3 Promotional Products,
    3. 30% off the price of the cheapest Promotional Product in the order, if the order contains at least 4 Promotional Products,
  4. The quantity of Promotional Products is limited. In justified circumstances, particularly if stocks are exhausted before the end of the Promotion Period, the duration of the promotion for a given Promotional Product may be shortened.
  5. This Promotion cannot be combined with other parallel promotions in the Mexen online store at www.mexen.ie, unless otherwise stated in these Terms and Conditions or in the terms and conditions of other promotions and discounts.
  6. The Organizer reserves the right to extend the Promotion Period.
  7. The discount cannot be exchanged for a cash equivalent or for any other form of payment.
  8. Promotional Products may also be included in another promotion organized by the Organizer at a different time, under the conditions specified in the terms and conditions of that promotion.

III. COMPLAINTS REGARDING THE PROMOTION

  1. Complaints regarding the Promotion can be submitted to the email address: [email protected] or to the correspondence address: „AGRAF” - Kieszkowski Rafał, ul. Strażacka 6, 05-084 Leszno.
  2. The Seller recommends that the Participant provides the following in the complaint description: (i) information and circumstances concerning the subject of the complaint; (ii) the Participant's request related to the complaint; and (iii) contact details of the complainant – this will facilitate and speed up the processing of the complaint by the Seller. The requirements stated in the preceding sentence are merely recommendations and do not affect the effectiveness of complaints submitted without adhering to these recommendations.
  3. Complaints will be processed within 14 days from the date of receipt of the complaint.
  4. The Participant will be notified of the outcome of the complaint resolution via return information, which will be sent in writing or to the email address from which the complaint was submitted, depending on the form of complaint chosen by the Participant.
  5. Furthermore, the Consumer has the following exemplary possibilities to use out-of-court methods for handling complaints and pursuing claims:
    • The Consumer may seek assistance from consumer advisory services or consumer protection organizations.
    • The Consumer may submit a complaint via the online ODR platform: https://ec.europa.eu/consumers/odr/. The ODR platform also provides a source of information on out-of-court dispute resolution methods that may arise between entrepreneurs and Consumers.
  6. The use of out-of-court methods for handling complaints and pursuing claims described in point 5 above is voluntary. The provisions of these Terms and Conditions regarding out-of-court dispute resolution methods and claims are for informational purposes and do not constitute an obligation for the Seller to use them. The Seller's statement of consent or refusal to participate in proceedings for out-of-court consumer dispute resolution is made by the Seller on paper or another durable medium if, following a complaint submitted by the Consumer, the dispute has not been resolved.

IV. PERSONAL DATA PROTECTION

  1. The Administrator of Participants' personal data is the Organizer. The processing of Participants' personal data takes place on the principles provided by applicable law and in accordance with the Organizer's privacy policy available during the Promotion Period on the website www.mexen.ie.
  2. The provision of Participants' personal data is voluntary, but it is necessary to enable the purchase of products within the Promotion.

V. RIGHT OF WITHDRAWAL FROM THE CONTRACT

  1. If a Participant of the Promotion, being a consumer, purchases a Product within the Promotion in the mexen.ie online store, they have the right to withdraw from the sales contract within 14 days from the date of receipt of the shipment without giving any reason. To meet this deadline, it is sufficient for the Participant to submit a statement of withdrawal from the sales contract. Issues of withdrawal from a distance contract are regulated in the online store's terms and conditions and in the section available at the URL: https://mexen.ie/zwroty, subject to the conditions below.
  2. Partial or complete withdrawal by the Participant from a sales contract concluded under the Promotion at a distance may result in the loss of Discounts granted to the Participant for participation in the Promotion.
  3. The Participant is obliged to return all granted Discounts or other benefits granted to the Participant.
  4. In a situation where products delivered under a single sales contract include Promotional Products, the Organizer is not obliged to agree to the return of products sold at full price (without simultaneously returning the remaining Products purchased with a Discount), because the Promotion rules imply that the Customer would not have received the given Discount if they had concluded the sales contract in a different form.
  5. The above assumptions in no way limit the Participant's right to withdraw from a distance contract, in accordance with applicable consumer protection laws.
  6. This section does not apply to Entrepreneurs. The provisions concerning consumers specified in this section also apply to contracts concluded from that date with Customers who are natural persons concluding a contract directly related to their business activity, when the content of these contracts indicates that they are not of a professional nature for them. To determine whether such a customer has consumer rights in specific circumstances, it is necessary to verify whether the concluded contract is of a professional nature.

VI. AMENDMENT OF THE TERMS AND CONDITIONS

  1. The Seller reserves the right to amend these Terms and Conditions for important reasons, which include, among others:
    1. the need to adapt technical and IT solutions for the organization of the Promotion to market conditions related to technical and IT progress.
    2. changes to existing or introduction of new generally applicable legal provisions that directly affect the content of these Terms and Conditions.
    3. issuance of an administrative decision or court ruling requiring an amendment to these Terms and Conditions.
    4. correction of obvious typographical errors.
  2. Introduced changes to the Terms and Conditions will not affect the rights acquired by the Promotion Participants. Changes to the Terms and Conditions will be published one day in advance. Participants who do not accept the provisions of the new Terms and Conditions may withdraw from participation in the Promotion.

VII. FINAL PROVISIONS

  1. These Terms and Conditions come into effect on April 6, 2026.
  2. In matters not regulated by these Terms and Conditions, the provisions of the Mexen online store Terms and Conditions at www.mexen.ie and applicable general legal provisions shall apply.
