Terms and Conditions for the "Carpenter's Days at Mexen" Promotion

I. General Provisions

  1. These Terms and Conditions define the rules of the promotion named “Carpenter's Days at Mexen”, hereinafter referred to as the “Promotion”.

  2. The organiser of the Promotion is: Agraf-Kieszkowski Rafał, ul. Strażacka 6, 05-084 Leszno (Poland), EU VAT number:PL1181563829, REGON: 141494553, E-mail: [email protected], hereinafter referred to as the “Organiser”.

  3. The Promotion is valid in the online shop operated at: www.mexen.ie.

  4. The Promotion is valid from 30 April 2026 at 00:00 until 5 May 2026 at 23:59:59, or until stocks last (hereinafter: “Promotion Period”).

  5. A condition for participating in the Promotion is reading and accepting these Terms and Conditions. Participation in the Promotion means acceptance of these Terms and Conditions.

  6. A participant in the Promotion is any customer of the mexen.ie shop who purchases Promotional Products during the Promotion Period.

  7. Customer, Consumer, and Entrepreneur are defined in accordance with the Terms and Conditions of the online shop www.mexen.ie.

II. Detailed Promotion Conditions

  1. Main Promotion: The Promotion consists of granting a discount:

    • A 10% discount applies to selected products within the 'Bathroom Furniture' category on www.mexen.ie. This discount specifically covers products in the subcategories: bathroom cabinets, countertops, cabinets with washbasins, cabinet bodies, and cabinet fronts. The 'bathroom mirrors' subcategory is explicitly excluded from this Promotion.

    Products covered by the Promotion will be clearly marked on the mexen.ie shop website.

    The discount is automatically applied in the shopping cart upon fulfilling the Promotion conditions.

  2. General Rules:

    Discounts are calculated from the current prices visible on the website at the time of placing the order.

    The Promotion can be combined with other promotions and price reductions visible in the online shop, unless separate conditions of a given promotion state otherwise. If multiple discounts apply, they will be applied sequentially or as determined by the system to offer the best possible price, but not cumulatively unless explicitly stated.

    The discount is granted automatically and is visible in the shopping cart.

    The discount amount cannot be exchanged for a monetary or material equivalent.

    The Promotion applies exclusively to sales made directly by the Organiser through the online shop www.mexen.ie.

III. Complaints Regarding the Promotion and Consumer Rights

  1. Complaints regarding the Promotion can be submitted to the email address: [email protected] or the correspondence address: Agraf-Kieszkowski Rafał, ul. Strażacka 6, 05-084 Leszno, Poland.

  2. The Organiser recommends that the Promotion Participant provides the following in the complaint description: (i) information and circumstances concerning the subject of the complaint; (ii) the Participant's request related to the complaint; and (iii) the contact details of the complainant – this will facilitate and speed up the processing of the complaint by the Organiser. The requirements given in the preceding sentence are merely recommendations and do not affect the effectiveness of complaints submitted without following these recommendations.

  3. Complaints will be processed within 14 days from the date of receipt of the complaint.

  4. The Promotion Participant will be informed about the outcome of the complaint resolution via a return message, which will be sent depending on the form of complaint chosen by the Promotion Participant, in writing or to the email address from which it was submitted.

  5. These Terms and Conditions do not limit any statutory rights of consumers under applicable Irish and EU law, including rights related to faulty goods or services. For more detailed information on consumer rights and complaint procedures for products purchased, please refer to our main Terms and Conditions on www.mexen.ie.

  6. Furthermore, the Consumer has the following exemplary possibilities to use out-of-court complaint and claim settlement methods:

    1. The Consumer may use the EU's Online Dispute Resolution (ODR) platform for out-of-court settlement of disputes concerning online purchases. This platform is available at: https://ec.europa.eu/consumers/odr/.

  7. The use of out-of-court complaint and claim settlement methods described in point 6 above is voluntary. The provisions of these Terms and Conditions regarding out-of-court dispute resolution and claim settlement methods are for informational purposes only and do not constitute an obligation for the Organiser to use them. However, the Organiser will always endeavour to resolve disputes amicably.

IV. Personal Data Protection

  1. The Organiser is the administrator of the personal data of the Participants. The processing of Participants' personal data takes place on the principles provided by applicable law, including the General Data Protection Regulation (GDPR) and relevant Irish data protection legislation, and in accordance with the Organiser's Privacy Policy available during the Promotion Period on www.mexen.ie.

  2. The personal data of Participants are provided voluntarily, but their provision is necessary to enable the purchase of products within the Promotion.

  3. Additional explanations regarding the protection of personal data are contained in the “Privacy Policy”.

V. Right of Withdrawal from the Agreement and Discount Adjustments

  1. In the event that a Promotion Participant, being a consumer, purchases a Product within the Promotion in the online shop www.mexen.ie, they have the right to withdraw from the sales agreement within 14 days from the date of receipt of the package without giving any reason, in accordance with applicable consumer protection laws. To meet this deadline, it is sufficient for the Promotion Participant to submit a declaration of withdrawal from the sales agreement. Issues regarding withdrawal from a distance contract are regulated in the online shop's Terms and Conditions, subject to the conditions below.

  2. If a Promotion Participant exercises their right of withdrawal for a product purchased with a discount under this Promotion, the refund will be for the actual discounted price paid for that specific product.

  3. If the withdrawal from the sales agreement (partial or total) results in the remaining part of the order no longer meeting the conditions required for the original discount or promotion to apply (e.g., minimum purchase value, specific product combination), the discount amount will be recalculated. In such cases, the value of the discount that is no longer applicable will be deducted from the refund amount for the returned product(s).

  4. These provisions regarding discount adjustments upon withdrawal do not limit the Promotion Participant's statutory right to withdraw from a distance contract as provided by law.

  5. This chapter does not apply to entrepreneurs.

VI. Amendments to the Terms and Conditions

  1. The Organiser reserves the right to amend these Terms and Conditions for important reasons, which include, but are not limited to:

    1. the need to adapt technical and IT solutions in the organisation of the Promotion to market conditions related to technical and IT progress.

    2. changes to existing or introduction of new generally applicable legal provisions that directly affect the content of the Terms and Conditions.

    3. issuance of an administrative decision or court ruling requiring a change to the Terms and Conditions.

    4. correction of obvious clerical errors.

  2. Introduced changes to the Terms and Conditions will not affect rights acquired by Promotion Participants. Changes to the Terms and Conditions will be published one day in advance. Promotion Participants who do not accept the provisions of the new Terms and Conditions may withdraw from participation in the Promotion.

VII. Final Provisions

  1. Participation in the Promotion means acceptance of these Terms and Conditions.

  2. In matters not regulated by these Terms and Conditions, the provisions of the online shop's Terms and Conditions at www.mexen.ie and applicable Irish and EU law shall apply.

  3. These Terms and Conditions are valid for the duration of the promotion, as specified in Section I, point 4.

  4. These terms and conditions shall be governed by and construed in accordance with Irish and EU Law and all parties shall submit to the exclusive jurisdiction of the Irish Courts.

  5. The parties expressly exclude the application of the UN Convention on Contracts for the International Sale of Goods.
