Terms and conditions of the "Bathtub Days" promotion

§ 1 PRELIMINARY PROVISIONS

  1. These Terms and Conditions define the rules of the promotion named “Bath Days”, hereinafter referred to as the “Promotion”.
  2. The organiser of the Promotion is:

    hereinafter referred to as the “Organiser”.
  3. The Promotion is valid in the online store operated at: MEXEN – www.mexen.ie
  4. The Promotion is valid from 1 September 2026 at 00:00 until 15 September 2026 at 23:59:59, or until stocks last (hereinafter: the “Promotion Period”).
  5. The condition for taking part in the Promotion is to read and accept these Terms and Conditions. Joining the Promotion means acceptance of these Terms and Conditions.
  6. A Participant of the Promotion is any customer of the mexen.ie store who purchases Promotional Products during the Promotion Period.
  7. Customer, Consumer and Entrepreneur are defined in accordance with the terms and conditions of the online store www.mexen.ie.

§ 2 DETAILED PROMOTION CONDITIONS

  1. Main promotion

    The Promotion consists in granting a discount:

    • 10% discount on the Freestanding Bathtubs category with the feature Installation: Freestanding on www.mexen.ie
    • Products covered by the Promotion will be marked on the mexen.ie store website.
    • The discount is applied automatically in the shopping cart once the Promotion conditions are met.
  2. General rules

    Discounts are calculated on the current prices visible on the website at the time the order is placed.

    The Promotion may be combined with other promotions and price reductions visible in the online store, unless the separate terms of a given promotion provide otherwise.

    The discount is granted automatically and is visible in the shopping cart.

    The discount amount cannot be exchanged for a cash or in-kind equivalent.

    The Promotion applies exclusively to sales made directly by the Organiser through the online store www.mexen.ie.

§ 3 COMPLAINTS CONCERNING THE PROMOTION

  1. Complaints concerning the Promotion may be submitted to the e-mail address: [email protected] or to the correspondence address “AGRAF” - Kieszkowski Rafał, ul. Strażacka 6, 05-084 Leszno.
  2. The Organiser recommends that the Promotion Participant include in the complaint description: (i) information and circumstances regarding the subject of the complaint; (ii) the Participant’s request related to the complaint; and (iii) the contact details of the person submitting the complaint – this will facilitate and speed up the handling of the complaint by the Organiser. The requirements set out in the preceding sentence are only a recommendation and do not affect the validity of complaints submitted without following this recommendation.
  3. Complaints will be handled by the Organiser within 14 days of receipt of the complaint.
  4. The Promotion Participant will be notified of the outcome of the complaint by a reply sent, depending on the form of complaint chosen by the Promotion Participant, in writing or to the e-mail address from which the complaint was submitted.
  5. In addition, the Consumer has the following example options for using out-of-court complaint and redress procedures:
    1. The Consumer is entitled to refer a dispute arising from the Sales Agreement to a competent alternative dispute resolution body in Ireland or to the European Consumer Centre Ireland.
    2. The Consumer may contact the Competition and Consumer Protection Commission [CCPC] or another competent Irish consumer authority for information and assistance in resolving a dispute with the Organiser.
    3. The Consumer may obtain free assistance from the European Consumer Centre Ireland or from consumer organisations whose statutory tasks include consumer protection.
    4. The Consumer may submit a complaint via the ODR online platform: https://ec.europa.eu/consumers/odr/. The ODR platform is also a source of information on out-of-court dispute resolution methods that may arise between traders and Consumers.
  6. Use of the out-of-court complaint and redress procedures described above is voluntary. The provisions of these Terms and Conditions concerning out-of-court dispute resolution and redress are informative and do not constitute an obligation of the Organiser to use them. The Organiser’s statement of consent or refusal to take part in consumer ADR proceedings is made on paper or another durable medium if, following a complaint submitted by the Consumer, the dispute has not been resolved.

§ 4 PERSONAL DATA PROTECTION

  1. The controller of Participants’ personal data is the Organiser. The processing of Participants’ personal data takes place in accordance with applicable law and with the Organiser’s privacy policy available during the Promotion Period on www.mexen.ie.
  2. Participants’ personal data are provided voluntarily, but providing them is necessary to enable the purchase of products under the Promotion.

§ 5 RIGHT OF WITHDRAWAL

  1. Where a Promotion Participant who is a consumer purchases a Product under the Promotion in the online store www.mexen.ie, they have the right to withdraw from the sales contract within 14 days of receipt of the parcel without giving any reason. To meet the above deadline it is sufficient for the Promotion Participant to submit a statement of withdrawal from the sales contract. Matters of withdrawal from a distance contract are set out in the online store’s terms and conditions and in the section available at: https://mexen.ie/returns.
  2. The above assumptions in no way limit the Promotion Participant’s right to withdraw from a distance contract in accordance with applicable Irish consumer protection law, including the Consumer Rights Act 2022.
  3. This chapter does not apply to Entrepreneurs. The consumer provisions set out in this chapter also apply, where applicable law so provides, to natural persons concluding a contract directly related to their business activity when it follows from the content of that contract that it is not of a professional nature for them.

§ 6 AMENDMENT OF THE TERMS AND CONDITIONS

  1. The Organiser reserves the right to amend these Terms and Conditions for an important reason, which includes in particular:
    1. the need to adapt technical and IT solutions used in organising the Promotion to market conditions related to technical and IT progress.
    2. a change to existing generally applicable legal provisions or the introduction of new ones that have a direct impact on the content of these Terms and Conditions.
    3. the issuance of an administrative decision or court ruling resulting in an obligation to amend these Terms and Conditions.
    4. correction of obvious clerical errors.
  2. Amendments to these Terms and Conditions will not affect rights acquired by Promotion Participants. Amendments will be published one day in advance. Promotion Participants who do not accept the provisions of the new Terms and Conditions may withdraw from participation in the Promotion.

§ 7 FINAL PROVISIONS

  1. Participation in the Promotion means acceptance of these Terms and Conditions.
  2. In matters not regulated by these Terms and Conditions, the provisions of the online store terms and conditions of www.mexen.ie and applicable Irish and EU law shall apply.
  3. These Terms and Conditions are valid for the duration of the Promotion specified in §1 point 4.
