§ 1 PRELIMINARY PROVISIONS
- This document defines the rules of the promotion named “Bathroom Days at Mexen”, hereinafter referred to as the “Promotion”.
- The Organiser of the Promotion is:

- The Promotion is valid in the online store operated at:
Mexen – www.mexen.ie
- The Promotion is valid from 1 August 2026 at 00:00 to 13 August 2026 at 23:59:59 or until stocks last (hereinafter: “Promotion Period”).
- A condition for participating in the Promotion is to read and accept these Terms and Conditions. By participating in the Promotion, the Promotion Participant is deemed to have accepted the Terms and Conditions.
- A Promotion Participant is any customer of the mexen.ie store who purchases Promotional Products in the mexen.ie store during the Promotion Period. The Promotion is aimed at all such customers.
§ 2 DETAILED PROMOTION CONDITIONS
- The Promotion applies to the purchase of products in the mexen.ie store marked on the product page with the information: “Bathroom Days” (hereinafter: “Promotional Products”), which are exclusively in the BATHROOM category.
- All Promotional Products during the Promotion Period will be placed on the mexen.ie store website and marked with a promotion tag.
- The Promotion consists of every person who, during the Promotion Period, purchases at least 2 Promotional Products in a single order in the mexen.ie online store, receiving a discount of:
- 10% of the price of the cheapest Promotional Product in the order, if there are exactly 2 Promotional Products in the order,
- 20% of the price of the cheapest Promotional Product in the order, if there are exactly 3 Promotional Products in the order,
- 30% of the price of the cheapest Promotional Product in the order, if there are exactly 4 Promotional Products in the order,
- The number of Promotional Products is limited. In justified circumstances, in particular in the event of stock depletion before the end of the Promotion Period, the duration of the promotion for a given Promotional Product may be shortened.
- This Promotion cannot be combined with other parallel promotions in the mexen.ie online store, unless otherwise stated in these Terms and Conditions or in the terms and conditions of other promotions and discounts.
- The Organiser reserves the right to extend the Promotion Period.
- The discount cannot be exchanged for a monetary equivalent or exchanged for any other means of payment.
- Promotional Products may also be included in another promotion organised by the Organiser at another time, under the conditions specified in the terms and conditions of that promotion.
§ 3 COMPLAINTS REGARDING THE PROMOTION
- Complaints regarding the Promotion can be submitted to the email address: [email protected] or the correspondence address: “AGRAF” - Kieszkowski Rafał, ul. Strażacka 6, 05-084 Leszno/Poland.
- The Organiser recommends that the Promotion Participant provides the following in the complaint description: (i) information and circumstances regarding the subject of the complaint; (ii) the Participant's request related to the complaint; and (iii) the contact details of the complainant – this will facilitate and speed up the processing of the complaint by the Organiser. The requirements given in the preceding sentence are only a recommendation and do not affect the effectiveness of complaints submitted without this recommendation.
- The Organiser undertakes to process each complaint immediately, no later than within 14 calendar days from the date of its receipt. Otherwise, the Organiser shall be deemed to have acknowledged the declaration or request as justified.
- The Promotion Participant will be notified of the outcome of the complaint by a return message, which will be sent to them in writing or to the email address from which the complaint was submitted, depending on the form chosen by the Promotion Participant.
- Furthermore, the Consumer has the following exemplary possibilities for out-of-court dispute resolution and claims:
- According to Article 14, paragraph 1-2 of Regulation of the European Parliament and of the Council (EU) No 524/2013 from 21 May 2013, the Organiser commits to placing information on the ODR platform. Online Dispute Resolution is intended to facilitate an independent, non-judicial settlement of disputes between consumers and traders through the Internet. These disputes relate to contractual obligations arising from online sales or service contracts concluded between consumers living in the Union and traders established in the Union.
- The Consumer who would like to take advantage of the possibility of an amicable resolution to disputes concerning online purchases may submit a complaint, for example, via the EU's Internet ODR platform which is available at: https://ec.europa.eu/consumers/odr/. The ODR platform also provides a source of information on forms of out-of-court dispute resolution that may arise between traders and Consumers.
- Consumers may also seek advice from local consumer protection bodies or organisations in Ireland for assistance with dispute resolution.
- The use of out-of-court methods of complaint resolution and claims described in point 5 above is voluntary. The provisions of these Terms and Conditions regarding out-of-court dispute resolution and claims are for informational purposes only and do not constitute an obligation for the Organiser to use them. The Organiser's statement of consent or refusal to participate in proceedings for out-of-court consumer dispute resolution is made by the Organiser on paper or another durable medium if, following a complaint submitted by the Consumer, the dispute has not been resolved.
§ 4 PROTECTION OF PERSONAL DATA
- The Organiser collects and processes the personal information of the Customers in accordance with applicable provisions of law and with the Privacy Policy available during the Promotion Period on the www.mexen.ie website.
- The personal data of Participants is provided voluntarily, but its provision is necessary to enable the purchase of products within the Promotion.
- Additional explanations regarding the protection of personal data are contained in the “Privacy Policy”.
§ 5 RIGHT OF WITHDRAWAL FROM THE AGREEMENT
- In the event that the Promotion Participant, being a consumer, purchases a Product as part of the Promotion in the mexen.ie online store, they have the right to withdraw from the sales agreement within 14 days from the date of receipt of the package without any reason. To meet the above deadline, it is sufficient for the Promotion Participant to submit a declaration of withdrawal from the sales agreement. Issues of withdrawal from a distance contract are regulated in the online store's terms and conditions and in the section available at the URL: https://mexen.ie/returns, subject to the conditions below.
- If a Promotion Participant, being a consumer, exercises their right of withdrawal for one or more Promotional Products purchased in a single order under this Promotion, and the remaining products no longer meet the conditions for the original discount (e.g., minimum number of items), the discount applied to the remaining products will be recalculated.
- In such a case, the Promotion Participant will be liable for the difference between the discounted price originally paid and the adjusted price of the retained products, reflecting the new discount eligibility (or full price if no discount conditions are met). The Organiser reserves the right to adjust the invoice or request payment for this difference.
- These provisions clarify the financial implications of partial withdrawal on promotional discounts and do not limit the Promotion Participant's statutory right to withdraw from a distance contract under applicable consumer protection law.
- This chapter does not apply to entrepreneurs.
§ 6 AMENDMENT OF THE TERMS AND CONDITIONS
- The Organiser reserves the right to amend these Terms and Conditions for important reasons, which include:
- the need to adapt technical and IT solutions for the organisation of the Promotion to market conditions related to technical and IT progress.
- a change in existing or the introduction of new generally applicable legal provisions that directly affect the content of the Terms and Conditions.
- the issuance of an administrative decision or court ruling necessitating a change to the Terms and Conditions.
- the correction of obvious clerical errors.
- Introduced changes to the Terms and Conditions will not affect rights acquired by Promotion Participants. Changes to the Terms and Conditions will be published one day in advance. Promotion Participants who do not accept the provisions of the new Terms and Conditions may withdraw from participation in the Promotion.
§ 7 FINAL PROVISIONS
- Participation in the Promotion means acceptance of these Terms and Conditions.
- These terms and conditions shall be governed by and construed in accordance with Irish and EU Law and all parties shall submit to the exclusive jurisdiction of the Irish Courts. The parties expressly exclude the application of the UN Convention on Contracts for the International Sale of Goods.
- For consumers, these Terms and Conditions, and any contracts concluded under them, are subject to the applicable consumer protection laws of Ireland, including but not limited to the Consumer Rights Act 2022 (which implements the Consumer Rights Directive 2011/83/EU) and the Sale of Goods and Supply of Services Act 1980.
- The Terms and Conditions are valid during the Promotion Period, as specified in §1 point 4.
