Terms and Conditions for the "Mexen Garden Days" Promotion

§ 1 General Provisions

  1. These Terms and Conditions define the rules of the promotion named "Mexen Garden Days", hereinafter referred to as the "Promotion".
  2. The organiser of the Promotion is: AGRAF – KIESZKOWSKI RAFAŁ, ul. Strażacka 6, 05-084 Leszno (Poland), EU VAT number: PL1181563829, REGON: 141494553, hereinafter referred to as the "Organiser".
  3. The Promotion is valid in the online store operated at: www.mexen.ie.
  4. The Promotion is valid from 15 July 2026 at 00:00 until 31 July 2026 at 23:59:59, or until stocks last (hereinafter: "Promotion Period").
  5. By participating in the Promotion, the Customer accepts these Terms and Conditions.
  6. A participant in the Promotion is any customer of the mexen.ie store who purchases Promotional Products during the Promotion Period.
  7. The terms "Customer", "Consumer", and "Entrepreneur" are defined in accordance with the terms and conditions of the online store www.mexen.ie.

§ 2 Detailed Promotion Conditions

  1. Main Promotion

    The Promotion consists of granting a discount:

    • 10% discount on the "Garden" category available on www.mexen.ie.
    • Products covered by the Promotion will be clearly marked on the mexen.ie store website.
    • The discount is applied automatically in the shopping cart upon meeting the Promotion conditions.
  2. General Rules

    Discounts are calculated from the current prices visible on the website at the time of placing the order.

    The Promotion can be combined with other promotions and price reductions visible in the online store, unless separate terms for a given promotion state otherwise.

    The discount is granted automatically and is visible in the shopping cart.

    The discount amount cannot be exchanged for a monetary or material equivalent.

    The Promotion applies exclusively to sales made directly by the Organiser through the online store www.mexen.ie.

§ 3 Complaints Regarding the Promotion

  1. Complaints regarding the Promotion can be submitted to the email address: [email protected] or the correspondence address: AGRAF - Kieszkowski Rafał, ul. Strażacka 6, 05-084 Leszno/Poland.
  2. The Organiser will process each complaint without undue delay, and no later than within 14 calendar days from the date of its receipt. Failure to respond within this period shall be deemed an acceptance of the complaint.
  3. It is recommended that the Promotion Participant provides the following in the complaint description: (i) information and circumstances regarding the subject of the complaint; (ii) the Participant's request related to the complaint; and (iii) the contact details of the person submitting the complaint – this will facilitate and speed up the processing of the complaint by the Organiser. Please note that providing this information is a recommendation and does not affect the effectiveness of complaints submitted without adhering to this recommendation.
  4. The Promotion Participant will be informed of the outcome of the complaint processing in writing or via email to the address from which the complaint was submitted, depending on the preferred communication method indicated by the Participant.
  5. Out-of-Court Dispute Resolution and Consumer Rights in Ireland

    These Terms and Conditions do not affect your statutory rights as a consumer under Irish and EU law. If you are not satisfied with the resolution of your complaint by the Organiser, you have several avenues for dispute resolution, including those provided by Irish consumer protection bodies and the courts.

    • Competition and Consumer Protection Commission (CCPC): The CCPC provides information on consumer rights and can assist with certain consumer complaints. You can find more information on their website: www.ccpc.ie.
    • Small Claims Court: For disputes involving amounts up to €2,000, consumers can use the Small Claims Court, which offers a simple and inexpensive way to resolve disputes without the need for legal representation. More information is available on the Citizens Information website (https://www.citizensinformation.ie/en/justice/courts_system/small_claims_court/) or the Courts Service website (https://www.courts.ie/small-claims).

    According to Article 14, paragraphs 1-2 of Regulation of the European Parliament and of the Council (EU) No 524/2013 from 21 May 2013, we commit ourselves to placing information on the ODR platform. Online Dispute Resolution is intended to facilitate an independent, non-judicial settlement of disputes between consumers and traders through the Internet. These disputes relate to contractual obligations arising from online sales or service contracts concluded between consumers living in the Union and traders established in the Union.

    The Consumer who would like to take advantage of the possibility of an amicable resolution to disputes concerning online purchases may submit a complaint, for example, via the EU's Internet ODR platform which is available at: http://ec.europa.eu/consumers/odr/.

§ 4 Protection of Personal Data

  1. The Organiser collects and processes the personal information of the Customers in accordance with applicable provisions of law and with the Privacy Policy available during the Promotion Period on www.mexen.ie.
  2. Personal data of Participants are provided voluntarily, but their provision is necessary to enable the purchase of products under the Promotion.
  3. Additional explanations regarding the protection of personal data are contained in the “Privacy Policy” on www.mexen.ie.

§ 5 Right to Withdraw from the Agreement

  1. In the event that a Promotion Participant, being a consumer, purchases a Product under the Promotion in the online store www.mexen.ie, they have the right to withdraw from the sales agreement within 14 calendar days from the date of receipt of the package without giving any reason. To meet this deadline, it is sufficient for the Promotion Participant to submit a declaration of withdrawal from the sales agreement. Issues related to withdrawal from a distance contract are regulated in the online store's terms and conditions and in the section available at https://mexen.ie/returns.
  2. Partial or complete cancellation by the Promotion Participant of a distance contract concluded under the Promotion may result in the loss of discounts granted to the Promotion Participant for participating in the Promotion.
  3. The Promotion Participant is obliged to return all discounts or other benefits granted to him/her under the Promotion if the conditions for the discount are no longer met due to the withdrawal.
  4. If the return of a product purchased under the Promotion results in the conditions for the discount no longer being met (e.g., returning only part of a bundle or an item that qualified for a discount on another item), the Organiser reserves the right to adjust the refund amount to reflect the actual price that would have been paid for the remaining items without the Promotion, or to require the return of all items purchased under the Promotion to receive a full refund.
  5. These provisions are in addition to, and do not limit, your statutory rights as a consumer under Irish and EU law, including your right to withdraw from a distance contract.
  6. This chapter does not apply to entrepreneurs.

§ 6 Amendment of the Terms and Conditions

  1. The Organiser reserves the right to amend these Terms and Conditions for important reasons, which include, but are not limited to:
    • the need to adapt technical and IT solutions for the organisation of the Promotion to market conditions related to technical and IT progress.
    • changes to existing or introduction of new generally applicable legal provisions that directly affect the content of these Terms and Conditions.
    • issuance of an administrative decision or court ruling necessitating a change to these Terms and Conditions.
    • correction of obvious typographical errors.
  2. Introduced changes to the Terms and Conditions will not affect the rights acquired by Promotion Participants. Changes to the Terms and Conditions will be published one day in advance. Promotion Participants who do not accept the provisions of the new Terms and Conditions may withdraw from participation in the Promotion.

§ 7 Final Provisions

  1. Participation in the Promotion signifies acceptance of these Terms and Conditions.
  2. In matters not regulated by these Terms and Conditions, the provisions of the www.mexen.ie online store regulations and applicable Irish and EU law shall apply.
  3. These Terms and Conditions are valid for the duration of the promotion, as specified in §1 point 4.
  4. Exclusion of Liability

    Please note that we only provide our Site for domestic and private use. You agree not to use our Site for any commercial or business purposes, and we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity. To the extent permitted by law, we exclude all conditions, warranties, representations or other terms which may apply to our Site or any content on it, whether express or implied.

    We will not be liable for any loss or damage caused by a virus, distributed denial-of-service attack, or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of our Site or to your downloading of any content on it, or on any website linked to it.

    Nothing in these Terms and Conditions excludes or limits our liability for death or personal injury arising from our negligence, or our fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by Irish law.

  5. Governing Law

    These Terms and Conditions shall be governed by and construed in accordance with Irish and EU Law and all parties shall submit to the exclusive jurisdiction of the Irish Courts.

    The parties expressly exclude the application of the UN Convention on Contracts for the International Sale of Goods.

  6. Nothing in these Terms and Conditions is intended to limit or exclude any statutory rights of consumers under Irish or EU law.
