§ 1 GENERAL PROVISIONS
- This document sets out the rules for the promotion titled "Floor Days at Mexen", hereinafter referred to as the "Promotion".
- The Organiser of the Promotion is:

hereinafter referred to as the "Organiser". - The Promotion is valid in the online store operated at:
Mexen – www.mexen.ie - The Promotion is valid from 16 May 2026 from 00:00 until 27 May 2026 until 23:59:59, or while stocks last (hereinafter: the "Promotion Period").
- A condition for participating in the Promotion is to read and accept these Terms and Conditions. By participating in the Promotion, the Participant is deemed to have accepted these Terms and Conditions.
- A Promotion Participant is any customer of the Mexen store who purchases Promotional Products in the Mexen store during the Promotion Period.
- A Customer is an entity purchasing a Product via the Online Store, concluding a Sales Agreement, who has legal capacity to effectively perform a specific action within the Online Store. A Consumer is a natural person performing a legal act with an entrepreneur that is not directly related to their business or professional activity. An Entrepreneur is a Customer, not being a Consumer, who concludes a Sales Agreement with the Seller for a purpose directly or indirectly related to their business or professional activity.
- This promotion is not a lottery or a mutual bet whose outcome depends on chance (drawing lots).
§ 2 DETAILED PROMOTION CONDITIONS
- The Promotion applies to the purchase of products in the Mexen store that are specifically marked with the “Floor Days” tag on their product page and belong to the following categories: floor and wall tiles, and laminate flooring (hereinafter: “Promotional Products”).
- All Promotional Products during the Promotion Period will be displayed on the Mexen store website and marked with a promotion tag.
- The discount is calculated according to the following thresholds, applicable to purchases made on mexen.ie:
- 49 EUR discount for every 350 EUR spent,
- 98 EUR discount for every 700 EUR spent,
- 147 EUR discount for every 1050 EUR spent,
etc. (discount calculated multiple times, proportionally to the basket value).
- Conditions for calculating the discount:
- a) The discount is calculated exclusively on the value of Promotional Products in the basket.
- b) The minimum amount of 350 EUR must be achieved exclusively by Promotional Products.
- c) The discount can only be used for Promotional Products.
- d) Products outside the indicated categories are not included in the discount threshold and are not covered by the discount.
- The discount is applied automatically in the shopping basket and is visible before placing the order.
- Discounts are calculated from the current prices visible on the website at the time of placing the order.
- The Promotion can be combined with other promotions valid in the store, unless the terms of those promotions state otherwise, and unless the discount mechanisms mutually exclude each other or separate conditions of a given promotion state otherwise.
- The discount amount:
- is not exchangeable for cash or any other equivalent,
- cannot be transferred to another order.
- The Promotion applies exclusively to sales made directly by the Organiser through the online store www.mexen.ie.
- In case of cancellation of an order or part thereof, the discount is recalculated according to the current value of Promotional Products in the basket.
§ 3 COMPLAINTS REGARDING THE PROMOTION
- Complaints regarding the Promotion can be submitted to the email address: [email protected] or the correspondence address: "AGRAF" - Kieszkowski Rafał, ul. Strażacka 6, 05-084 Leszno, Poland.
- The Seller recommends that the Promotion Participant provides in the complaint description: (i) information and circumstances concerning the subject of the complaint; (ii) the Participant's request related to the complaint; and (iii) the contact details of the complainant – this will facilitate and speed up the Seller's consideration of the complaint. The requirements given in the preceding sentence are merely a recommendation and do not affect the effectiveness of complaints submitted without adhering to this recommendation.
- Complaints will be processed within 14 days from the date of receipt of the complaint.
- The Promotion Participant will be notified of the outcome of the complaint by a return message, which will be sent to them in writing or to the email address from which the complaint was submitted, depending on the form of complaint chosen by the Promotion Participant.
- Furthermore, the Consumer has the following exemplary possibilities for out-of-court dispute resolution and claims:
- a. According to article 14, paragraph. 1-2 of Regulation of the European Parliament and of the Council (EU) No 524/2013 from 21 May 2013, we commit ourselves to placing information on the ODR platform. Online Dispute Resolution is intended to facilitate an independent, non-judicial settlement of disputes between consumers and traders through the Internet. These disputes relate to contractual obligations arising from online sales or service contracts concluded between consumers living in the Union and traders established in the Union.
- b. The Consumer who would like to take advantage of the possibility of an amicable resolution to disputes concerning online purchases may submit a complaint, for example, via the EU's Internet ODR platform which is available at: https://ec.europa.eu/consumers/odr/.
- The use of out-of-court dispute resolution methods and claims described in point 5 above is voluntary. The provisions of these Terms and Conditions regarding out-of-court dispute resolution methods and claims are for informational purposes only and do not constitute an obligation for the Seller to use them.
§ 4 PERSONAL DATA PROTECTION
- The administrator of the Participants' personal data is the Organiser. The processing of Participants' personal data takes place on the principles provided by applicable law and in accordance with the Organiser's privacy policy available during the Promotion Period on the website www.mexen.ie.
- The personal data of Participants is provided voluntarily, but its provision is necessary to enable the purchase of products within the Promotion.
§ 5 RIGHT OF WITHDRAWAL FROM THE AGREEMENT
- In the event that a Promotion Participant, being a consumer, purchases a Product under the Promotion in the online store www.mexen.ie, they have the right to withdraw from the sales agreement within 14 days from the date of receipt of the package without any reason. To meet the above deadline, it is sufficient for the Promotion Participant to submit a declaration of withdrawal from the sales agreement. Issues of withdrawal from a distance contract are regulated in the online store's terms and conditions and in the section available at: https://mexen.ie/returns, subject to the conditions below.
- Partial or complete withdrawal by the Promotion Participant from a distance sales agreement concluded under the Promotion may result in the loss of Discounts granted to the Promotion Participant due to participation in the Promotion.
- The Promotion Participant is obliged to return all granted Discounts or other benefits granted to the Promotion Participant that are no longer due as a result of the withdrawal from the agreement.
- In a situation where products delivered under a single sales agreement include Promotional Products, and a partial withdrawal from the sales agreement means that the remaining Promotional Products no longer meet the conditions for the originally calculated discount, the discount will be recalculated according to the current value of the Promotional Products in the basket, and the refund amount will be adjusted accordingly.
- The above assumptions in no way limit the Promotion Participant's statutory right to withdraw from a distance contract, in accordance with applicable Irish consumer protection laws, including but not limited to the Consumer Rights Act 2022.
- This chapter does not apply to Entrepreneurs. The provisions concerning consumers specified in this chapter also apply to agreements concluded from this date with Customers who are natural persons concluding an agreement directly related to their business activity, when the content of these agreements indicates that they are not of a professional nature for them.
§ 6 CHANGES TO THE TERMS AND CONDITIONS
- The Seller reserves the right to change these Terms and Conditions for important reasons, which include, but are not limited to:
- the need to adapt technical and IT solutions in the organisation of the Promotion to market conditions related to technical and IT progress.
- changes to existing or introduction of new generally applicable legal provisions that directly affect the content of these Terms and Conditions.
- issuance of an administrative decision or court ruling necessitating a change to these Terms and Conditions.
- correction of obvious typographical errors.
- Introduced changes to the Terms and Conditions will not affect the rights acquired by Promotion Participants. Changes to the Terms and Conditions will be published one day in advance. Promotion Participants who do not accept the provisions of the new Terms and Conditions may withdraw from participation in the Promotion.
§ 7 FINAL PROVISIONS
- Participation in the Promotion means acceptance of these Terms and Conditions.
- In matters not regulated by these Terms and Conditions, the provisions of the Terms and Conditions of the www.mexen.ie online store shall apply, along with applicable Irish consumer protection legislation, including the Consumer Rights Act 2022. These Terms and Conditions shall be governed by and construed in accordance with Irish and EU Law and all parties shall submit to the exclusive jurisdiction of the Irish Courts.
- These Terms and Conditions are valid for the duration of the promotion, as specified in §1 point 4.
§ 8 LIMITATION OF LIABILITY
- Nothing in these Terms and Conditions shall limit or exclude our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other matter for which it would be unlawful for us to exclude or attempt to exclude our liability. This includes your statutory rights as a consumer under Irish law.
- We provide our Site for domestic and private use only. You agree not to use our Site for any commercial or business purposes, and we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity if you are acting as a consumer.
- While we take reasonable care to ensure the accuracy of information on our Site, we do not guarantee that the Site, or any content on it, will always be available or be uninterrupted. To the extent permitted by law, we exclude all implied conditions, warranties, representations or other terms that may apply to our Site or any content on it, except where such exclusion would be unlawful or would limit your statutory rights as a consumer.
- We will not be liable for any loss or damage caused by a virus, distributed denial-of-service attack, or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of our Site or to your downloading of any content on it, or on any website linked to it, unless caused by our negligence or breach of these terms.
