Terms and Conditions for the Promotion “Kitchen Days at Mexen”

§ 1 GENERAL PROVISIONS

  1. These Terms and Conditions define the rules of the promotion named “Kitchen Days at Mexen”, hereinafter referred to as the “Promotion”.
  2. The organiser of the Promotion is:

    hereinafter referred to as the “Organiser”.

  3. The Promotion is valid in the online store operated at:

    Mexen – www.mexen.pl

  4. The Promotion is valid from September 16, 2026, from 00:00, until September 29, 2026, at 23:59:59, or until stocks last (hereinafter: “Promotion Period”).
  5. A prerequisite for participating in the Promotion is reading and accepting these Terms and Conditions. By participating in the Promotion, the Promotion Participant is deemed to have accepted these Terms and Conditions.
  6. A Promotion Participant is any customer of the mexen.pl store who purchases Promotional Products in the mexen.pl store during the Promotion Period.
  7. A Customer is an entity purchasing a Product via the Online Store, concluding a Sales Agreement, who has legal capacity to effectively perform a specific action within the Online Store. A Consumer is a natural person who performs a legal act with an entrepreneur that is not directly related to their business or professional activity. An Entrepreneur is a Customer, not being a Consumer, who concludes a Sales Agreement with the Seller for a purpose directly or indirectly related to their business or professional activity.
  8. This promotion is not a lottery or a mutual bet, the outcome of which depends on chance (drawing), within the meaning of gambling laws.

§ 2 DETAILED PROMOTION CONDITIONS

  1. The Promotion applies to the purchase of products in the mexen.pl store marked on the product page with the information: “Kitchen Days” (hereinafter: “Promotional Products”), which are exclusively in the KITCHEN category.
  2. All Promotional Products during the Promotion will be placed on the mexen.pl store page and marked with a promotion tag.
  3. The Promotion consists of every person who, during the Promotion Period, purchases at least 2 Promotional Products in a single order in the mexen.pl online store, receiving a discount of:
    1. 10% of the price of the cheapest Promotional Product in the order, if there are exactly 2 Promotional Products in the order,
    2. 20% of the price of the cheapest Promotional Product in the order, if there are exactly 3 Promotional Products in the order,
    3. 30% of the price of the cheapest Promotional Product in the order, if there are exactly 4 Promotional Products in the order,
  4. The number of Promotional Products is limited. In justified circumstances, particularly in the event of stock depletion before the end of the Promotion Period, the duration of the promotion for a given Promotional Product may be shortened.
  5. This Promotion cannot be combined with other parallel promotions in the Online Store www.mexen.pl, unless otherwise stated in these Terms and Conditions or in the terms and conditions of other promotions and discounts.
  6. The Organiser reserves the right to extend the validity period of the promotion.
  7. The discount cannot be exchanged for a monetary equivalent or exchanged for another means of payment.
  8. Promotional Products may also be included in another promotion organised by the Organiser at another time, under the conditions specified in the terms and conditions of that promotion.

§ 3 COMPLAINTS REGARDING THE PROMOTION

  1. Complaints regarding the Promotion can be submitted to the email address: [email protected] or the correspondence address: MEXEN Sp. z o.o. formerly „AGRAF” - KIESZKOWSKI RAFAŁ, ul. Strażacka 6, 05-084 Leszno (Poland).
  2. The Seller recommends that the Promotion Participant provides in the complaint description: (i) information and circumstances regarding the subject of the complaint; (ii) the Participant's request related to the complaint; and (iii) the contact details of the complainant – this will facilitate and speed up the consideration of the complaint by the Seller. The requirements given in the preceding sentence are only a recommendation and do not affect the effectiveness of complaints submitted without observing this recommendation.
  3. Complaints will be processed within 14 days from the date of receipt of the complaint.
  4. The Promotion Participant will be notified of the outcome of the complaint by a return message, which will be sent to them, depending on the form of complaint chosen by the Promotion Participant, in writing or to the email address from which it was submitted.
  5. The Consumer who would like to take advantage of the possibility of an amicable resolution to disputes concerning online purchases may submit a complaint, for example, via the EU's Internet ODR platform which is available at: https://ec.europa.eu/consumers/odr/. The ODR platform also provides a source of information on out-of-court dispute resolution methods that may arise between entrepreneurs and Consumers.
  6. The use of out-of-court methods of complaint handling and claims described in point 5 above is voluntary. The provisions of these Terms and Conditions regarding out-of-court dispute resolution and claims are for informational purposes and do not constitute an obligation for the Seller to use them.

§ 4 PERSONAL DATA PROTECTION

  1. The administrator of the Participants' personal data is the Organiser. The processing of Participants' personal data takes place on the principles provided by applicable law and in accordance with the Organiser's privacy policy available during the Promotion Period on the website www.mexen.pl.
  2. The personal data of Participants is provided voluntarily, but its provision is necessary to enable the purchase of products within the Promotion.

§ 5 RIGHT OF WITHDRAWAL FROM THE AGREEMENT

  1. In the event that the Promotion Participant, who is a consumer, purchases a Product as part of the Promotion via the online shop www.mexen.pl, they have the right to withdraw from the purchase contract within 14 days of receipt of the package without giving reasons. In order to comply with the above-mentioned deadline, it is sufficient for the Promotion Participant to submit a declaration of cancellation of the purchase contract. Issues of withdrawal from a distance contract are regulated in the online store's terms and conditions and in the section available at the URL: https://mexen.ie/returns, subject to the conditions below.
  2. Partial or complete withdrawal by the Promotion Participant from a distance contract concluded under the Promotion may result in the loss of discounts granted to the Promotion Participant for participating in the Promotion.
  3. The Promotion Participant is obliged to return all discounts or other benefits granted to them under the Promotion.
  4. In a situation where the products delivered under a purchase contract contain Promotional Products, the Organiser is not obliged to allow the return of the products sold at full price (without the simultaneous return of the remaining products purchased at a discount), as it follows from the rules of the Promotion that the customer would not receive the discount granted if they had concluded a purchase contract in another form.
  5. The above assumptions in no way limit the right of the Promotion Participant to withdraw from a contract concluded at a distance.
  6. This chapter does not apply to entrepreneurs.

§ 6 AMENDMENT OF THE TERMS AND CONDITIONS

  1. The Seller reserves the right to amend these Terms and Conditions for a valid reason, which includes, among others:
    1. the need to adapt technical and IT solutions in the organisation of the Promotion to market conditions related to technical and IT progress.
    2. a change in existing or the introduction of new generally applicable legal provisions that directly affect the content of the Terms and Conditions.
    3. the issuance of an administrative decision or court ruling necessitating a change to the Terms and Conditions.
    4. correction of obvious typographical errors.
  2. Introduced changes to the Terms and Conditions will not affect the rights acquired by the Promotion Participants. Changes to the Terms and Conditions will be published with one day's notice. Promotion Participants who do not accept the provisions of the new Terms and Conditions may withdraw from participation in the Promotion.

§ 7 FINAL PROVISIONS

  1. Participation in the Promotion means acceptance of these Terms and Conditions.
  2. In matters not regulated by these Terms and Conditions, the provisions of the www.mexen.pl online store's terms and conditions and applicable Polish law shall apply. All parties shall submit to the exclusive jurisdiction of the Polish Courts. The parties expressly exclude the application of the UN Convention on Contracts for the International Sale of Goods.
  3. These Terms and Conditions are valid for the duration of the promotion, as specified in §1 point 4.
