Terms and Conditions for the "Design Days by Mexen" Promotion

§ 1 GENERAL PROVISIONS

  1. These Terms and Conditions define the rules for the promotion named “Design Days by Mexen”, hereinafter referred to as the “Promotion”.

  2. The Organiser of the Promotion is:

    hereinafter referred to as the “Organiser”.

  3. The Promotion is valid in the online store operated at:
    MEXEN – www.mexen.pl. These Terms and Conditions are published on mexen.ie for informational purposes for customers in Ireland.
  4. The Promotion is valid from 20 May 2026 at 00:00 IST to 28 May 2026 at 23:59:59 IST (Irish Standard Time) or until stocks last (hereinafter: “Promotion Period”).
  5. A condition for participating in the Promotion is to read and accept these Terms and Conditions. Participation in the Promotion signifies acceptance of these Terms and Conditions.
  6. The Participant of the Promotion is every customer who purchases Promotional Products on www.mexen.pl during the Promotion Period.
  7. Customer, Consumer, and Entrepreneur are defined in accordance with the terms and conditions of the mexen.pl online store.

§ 2 DETAILED PROMOTION CONDITIONS

  1. Main Promotion

    The Promotion consists of granting a discount:

    • 10% discount on the Countertop Washbasins category available on www.mexen.pl, and 15% discount on the AURA washbasin series
    • Products covered by the Promotion will be marked on the mexen.pl store website.
    • The discount is applied automatically in the shopping cart upon fulfilling the Promotion conditions.

  2. General Rules

    Discounts are calculated from the current prices visible on the website at the time of placing the order.

    The Promotion can be combined with other promotions and price reductions visible in the online store, unless separate terms of a given promotion state otherwise.

    The discount is granted automatically and is visible in the shopping cart.

    The discount amount cannot be exchanged for a monetary or material equivalent.

    The Promotion applies exclusively to sales made directly by the Organiser through the online store www.mexen.pl.

§ 3 COMPLAINTS REGARDING THE PROMOTION

  1. Consumers in Ireland have the right to submit complaints regarding the Promotion. Complaints can be submitted to the email address: [email protected] or the correspondence address: „AGRAF” - Kieszkowski Rafał, ul. Strażacka 6, 05-084 Leszno/Poland.
  2. The Seller recommends that the Promotion Participant provides the following in the complaint description: (i) information and circumstances regarding the subject of the complaint; (ii) the Participant's request related to the complaint; and (iii) the contact details of the person submitting the complaint – this will facilitate and speed up the processing of the complaint by the Seller. The requirements given in the preceding sentence are merely recommendations and do not affect the effectiveness of complaints submitted without following these recommendations.
  3. Complaints will be processed within 14 days from the date of receipt of the complaint.
  4. The Promotion Participant will be notified of the outcome of the complaint resolution by return information, which will be sent to them, depending on the form of complaint chosen by the Promotion Participant, in writing or to the email address from which it was submitted.

  5. Furthermore, the Consumer has the following exemplary possibilities to use out-of-court methods of handling complaints and pursuing claims:

    1. The Consumer who would like to take advantage of the possibility of an amicable resolution to disputes concerning online purchases may submit a complaint, for example, via the EU's Internet ODR platform which is available at: https://ec.europa.eu/consumers/odr/. The ODR platform also provides a source of information on out-of-court dispute resolution methods that may arise between entrepreneurs and Consumers.
    2. In Ireland, consumers can also seek advice or assistance from the Competition and Consumer Protection Commission (CCPC) regarding their consumer rights and potential dispute resolution options. More information can be found on their website: https://www.ccpc.ie/.
  6. The use of out-of-court methods of handling complaints and pursuing claims described in point 5 above is voluntary. The provisions of these Terms and Conditions regarding out-of-court dispute resolution and claims pursuit are for informational purposes and do not constitute an obligation for the Seller to use them. The Seller's statement of consent or refusal to participate in proceedings for out-of-court consumer dispute resolution is made by the Seller on paper or another durable medium if, following a complaint submitted by the Consumer, the dispute has not been resolved.

§ 4 PROTECTION OF PERSONAL INFORMATION

  1. The Organiser is the administrator of the personal data of the Participants. The processing of Participants' personal data takes place on the principles provided by applicable law and in accordance with the Organiser's privacy policy available during the Promotion Period on the website www.mexen.pl.
  2. The personal data of Participants are provided voluntarily, but their provision is necessary to enable the purchase of products within the Promotion.

§ 5 RIGHT TO WITHDRAW FROM THE AGREEMENT

  1. In the event that the Promotion Participant, who is a consumer, purchases a Product as part of the Promotion via the online shop www.mexen.pl, they have the right to withdraw from the purchase contract within 14 days of receipt of the package without giving reasons. In order to comply with the above-mentioned deadline, it is sufficient for the Promotion Participant to submit a declaration of cancellation of the purchase contract. Issues regarding withdrawal from a distance contract are regulated in the online store's terms and conditions on www.mexen.pl and are subject to Polish law, as the contract is concluded on www.mexen.pl. This information is provided for the benefit of Irish consumers, subject to the conditions below.
  2. Partial or complete withdrawal by the Promotion Participant from a distance contract concluded under the Promotion may result in the loss of discounts granted to the Promotion Participant for participating in the Promotion.
  3. The Promotion Participant is obliged to return all granted discounts or other benefits granted to them under the Promotion.
  4. If the return of one or more items from an order containing promotional products means that the original purchase no longer meets the conditions for the granted discount, the Organiser reserves the right to adjust the refund amount. This adjustment will reflect the actual price of the items kept, as if the discount had not been applied, or may require the return of all items purchased under the promotion to maintain the discount's validity.
  5. The above assumptions in no way limit the right of the Promotion Participant to withdraw from a contract concluded at a distance, in accordance with applicable consumer protection law.
  6. This chapter does not apply to entrepreneurs.

§ 6 CHANGES TO THE TERMS AND CONDITIONS

  1. The Seller reserves the right to change these Terms and Conditions for a valid reason, which includes, among others:

    1. the necessity to adapt technical and IT solutions for the organisation of the Promotion to market conditions related to technical and IT progress.
    2. a change in existing or the introduction of new generally applicable legal provisions that directly affect the content of the Terms and Conditions.
    3. the issuance of an administrative decision or court ruling necessitating a change to the Terms and Conditions.
    4. correction of obvious typographical errors.
  2. Introduced changes to the Terms and Conditions will not affect rights acquired by Promotion Participants. Changes to the Terms and Conditions will be published one day in advance. Promotion Participants who do not accept the provisions of the new Terms and Conditions may withdraw from participation in the Promotion.

§ 7 FINAL PROVISIONS

  1. Participation in the Promotion means acceptance of these Terms and Conditions.
  2. In matters not regulated by these Terms and Conditions, the provisions of the mexen.pl online store's terms and conditions and applicable Polish and EU law shall apply to the purchase contract concluded on www.mexen.pl. However, for any disputes or complaints specifically concerning the interpretation or application of *these Promotion Terms and Conditions* as published on mexen.ie, Irish and EU law shall apply.
  3. These Terms and Conditions are valid during the Promotion Period, as specified in §1 point 4.
