Terms And Conditions Of The "Mexen in Black - SECRET PROMOTION"

§ 1 GENERAL PROVISIONS

1. These Terms and Conditions define the rules of the promotion named "Mexen in Black - SECRET PROMOTION", hereinafter referred to as the "Promotion".

2. The organiser of the Promotion is:

   hereinafter referred to as the "Organiser".

3. The Promotion is valid in the online store operated at:
   MEXEN – www.mexen.ie

4. The Promotion is valid from 19 November 2026 at 00:00 until 19 November 2026 at 23:59:59, or until stocks last (hereinafter: the "Promotion Period").

5. A condition for participating in the Promotion is to read and accept these Terms and Conditions. By participating in the Promotion, the Promotion Participant is deemed to have accepted these Terms and Conditions.

6. A Promotion Participant is any customer of the mexen.ie store who purchases Promotional Products in the mexen.ie store during the Promotion Period.

7. A Customer is an entity purchasing a Product through the Online Store, entering into a Sales Agreement, who has the legal capacity to effectively perform a specific action within the Online Store. A Consumer is a natural person performing a legal act with an entrepreneur that is not directly related to their business or professional activity. An Entrepreneur is a Customer, not being a Consumer, who enters into a Sales Agreement with the Seller for a purpose directly or indirectly related to their business or professional activity.

8. This promotion is not a lottery or a mutual bet whose outcome depends on chance (drawing) in the understanding of applicable gambling laws.

§ 2 DETAILED PROMOTION CONDITIONS

1. The Promotion applies to the purchase of at least 2 products in the mexen.ie store (hereinafter: "Promotional Products").

2. All Promotional Products will be displayed on the mexen.ie store website during the Promotion Period.

3. The Promotion consists of the following: any person who, during the Promotion Period, makes a purchase in the mexen.ie online store and enters a discount code previously received via email, as part of a single order for at least 2 Promotional Products, will receive a discount:

   1. 20% of the price of the cheapest Promotional Product in the order, if the order contains exactly 2 Promotional Products,

   2. or 30% of the price of the cheapest Promotional Product in the order, if the order contains exactly 3 Promotional Products,

   3. or 40% of the price of the cheapest Promotional Product in the order, if the order contains exactly 4 Promotional Products,

   4. or 50% of the price of the cheapest Promotional Product in the order, if the order contains exactly 5 Promotional Products.

4. The quantity of Promotional Products is limited. In justified circumstances, particularly in the event of stock depletion before the end of the Promotion Period, the duration of the promotion for a given Promotional Product may be shortened.

5. This Promotion cannot be combined with other parallel promotions in the www.mexen.ie Online Store.

6. The Organiser reserves the right to extend the Promotion Period.

7. The discount cannot be exchanged for a cash equivalent or any other form of payment.

8. Promotional Products may also be included in another promotion organised by the Organiser at a different time, under the conditions specified in the terms and conditions of that promotion. Discounts are calculated based on the current prices visible on the website at the time of placing the order.

9. The discount is applied after entering the discount code and is visible in the shopping cart (after entering the aforementioned code).

§ 3 COMPLAINTS REGARDING THE PROMOTION

1. Complaints regarding the Promotion can be submitted to the email address: [email protected] or the correspondence address: MEXEN Sp. z o.o. formerly „AGRAF” - KIESZKOWSKI RAFAŁ, ul. Strażacka 6, 05-084 Leszno, Poland.

2. The Seller recommends that the Promotion Participant provides in the complaint description: (i) information and circumstances concerning the subject of the complaint; (ii) the Participant's request related to the complaint; and (iii) the contact details of the complainant – this will facilitate and speed up the processing of the complaint by the Seller. The requirements stated in the preceding sentence are merely recommendations and do not affect the effectiveness of complaints submitted without adhering to these recommendations.

3. The Organiser undertakes to process each complaint immediately, no later than within 14 calendar days from the date of its receipt. Otherwise, the Organiser shall be deemed to have acknowledged the declaration or request as justified.

4. The Promotion Participant will be notified of the outcome of the complaint resolution via a return message, which will be sent depending on the form of complaint chosen by the Promotion Participant, in writing or to the email address from which it was submitted.

5. Furthermore, the Consumer has the possibility to use out-of-court dispute resolution methods. The Consumer who would like to take advantage of the possibility of an amicable resolution to disputes concerning online purchases may submit a complaint, for example, via the EU's Internet ODR platform which is available at: https://ec.europa.eu/consumers/odr/. The ODR platform also provides a source of information on out-of-court dispute resolution methods that may arise between entrepreneurs and Consumers.

6. The use of out-of-court methods for handling complaints and pursuing claims described in point 5 above is voluntary. The provisions of these Terms and Conditions regarding out-of-court dispute resolution methods are for informational purposes only and do not constitute an obligation for the Seller to use them. The Seller's statement of consent or refusal to participate in proceedings for out-of-court settlement of consumer disputes is made by the Seller on paper or another durable medium if, following a complaint submitted by the Consumer, the dispute has not been resolved.

§ 4 PROTECTION OF PERSONAL DATA

1. The Organiser collects and processes the personal information of the Customers in accordance with applicable provisions of law and with the Privacy Policy, available during the Promotion Period on the website www.mexen.ie.

2. The personal data of Participants is provided voluntarily, but its provision is necessary to enable the purchase of products within the Promotion.

§ 5 RIGHT TO WITHDRAW FROM THE AGREEMENT

1. In the event that the Promotion Participant, being a consumer, purchases a Product as part of the Promotion in the online store www.mexen.ie, they have the right to withdraw from the sales agreement within 14 days from the date of receipt of the package without giving any reason. To meet this deadline, it is sufficient for the Promotion Participant to submit a declaration of withdrawal from the sales agreement. Issues related to withdrawal from a distance contract are regulated in the online store's terms and conditions and in the section available at the URL: https://mexen.ie/returns, subject to the conditions below.

2. Partial or complete withdrawal by the Promotion Participant from a sales agreement concluded under the Promotion at a distance may result in the loss of discounts granted to the Promotion Participant for participating in the Promotion.

3. The Promotion Participant is obliged to return all granted discounts or other benefits granted to the Promotion Participant.

4. In a situation where the products delivered under a single sales agreement include Promotional Products, the Organiser is not obliged to agree to the return of products sold at full price (without the simultaneous return of the remaining products purchased with a discount), because the rules of the Promotion imply that the Customer would not have received the given discount if they had concluded a sales agreement in a different form.

5. The above assumptions in no way limit the Promotion Participant's right to withdraw from a distance contract, in accordance with applicable consumer protection laws.

6. This chapter does not apply to Entrepreneurs. The provisions concerning consumers specified in this chapter also apply to agreements concluded from this date with Customers who are natural persons entering into an agreement directly related to their business activity, when the content of these agreements indicates that they do not have a professional character for them. To determine whether such a customer has consumer rights in specific circumstances, it is necessary to verify whether the concluded agreement has a professional character based on the entry of this entrepreneur in public registers of economic activity.

§ 6 AMENDMENT OF THE TERMS AND CONDITIONS

1. The Seller reserves the right to amend these Terms and Conditions for a valid reason, which includes, but is not limited to:

   1. the need to adapt technical and IT solutions for the organisation of the Promotion to market conditions related to technical and IT progress.

   2. changes to existing or introduction of new generally applicable legal provisions that directly affect the content of the Terms and Conditions.

   3. issuance of an administrative decision or court ruling requiring an amendment to the Terms and Conditions.

   4. correction of obvious clerical errors.

2. Any introduced changes to the Terms and Conditions will not affect the rights acquired by Promotion Participants. Changes to the Terms and Conditions will be published one day in advance. Promotion Participants who do not accept the provisions of the new Terms and Conditions may withdraw from participation in the Promotion.

§ 7 FINAL PROVISIONS

1. Participation in the Promotion means acceptance of these Terms and Conditions.

2. In matters not regulated by these Terms and Conditions, the provisions of the www.mexen.ie online store's Terms and Conditions and applicable Irish and EU Law shall apply. For consumers, the mandatory provisions of the law of their habitual residence (e.g., Ireland) shall apply. Any disputes arising from these Terms and Conditions shall be subject to the jurisdiction of the competent courts in accordance with applicable Irish and EU law.

3. These Terms and Conditions are valid for the duration of the promotion, as specified in §1 point 4.
