Terms and Conditions for the "Month of Multi-Discounts" Promotion

§ 1 General Provisions

1. These Terms and Conditions define the rules of the promotion named „Month of Multi-Discounts”, hereinafter referred to as the „Promotion”.
2. The Organiser of the Promotion is:

   hereinafter referred to as the „Organiser”.

3. The Promotion is valid in the online store operated at:

   Mexen – www.mexen.ie

4. The Promotion is valid from June 1, 2026, from 00:00 until June 30, 2026, until 23:59:59 (hereinafter: „Promotion Period”).
5. A condition for participating in the Promotion is to read and accept these Terms and Conditions. By participating in the Promotion, the Promotion Participant is deemed to have accepted these Terms and Conditions.
6. A Promotion Participant is any customer of the Mexen store who purchases Promotional Products in the Mexen store during the Promotion Period.
7. A Customer is an entity purchasing a Product via the Online Store, concluding a Sales Agreement, who has the legal capacity to effectively perform a specific action within the Online Store. A Consumer is a natural person performing a legal action with an entrepreneur that is not directly related to their business or professional activity. An Entrepreneur is a Customer, not being a Consumer, who concludes a Sales Agreement with the Seller for a purpose directly or indirectly related to their business or professional activity.
8. This promotion is not a game of chance or a mutual bet, the outcome of which depends on chance (drawing lots).

§ 2 Detailed Terms of the Promotion

1. All promotional products during the Promotion Period will be placed on the Mexen store website and clearly marked with a promotion sticker or badge.
2. The Promotion consists of every person who, during the Promotion Period, makes a purchase of Promotional Products in the Mexen online store as part of a single order, in a quantity of at least 3 items, receiving a discount of:
   1. 20% of the price of the cheapest Promotional Product in the order, if the order contains exactly 3 Promotional Products,
   2. 30% of the price of the cheapest Promotional Product in the order, if the order contains exactly 4 Promotional Products,
   3. 40% of the price of the cheapest Promotional Product in the order, if the order contains exactly 5 Promotional Products.
3. This Promotion cannot be combined with other parallel promotions in the Mexen online store, unless otherwise stated in these Terms and Conditions or in the terms and conditions of other promotions and discounts.
4. The discount cannot be exchanged for a cash equivalent or any other means of payment.
5. Promotional Products may also be subject to another promotion organised by the Organiser at a different time, under the conditions specified in the terms and conditions of that promotion.

§ 3 Complaints regarding the Promotion

1. Complaints regarding the Promotion can be submitted to the email address: [email protected] or the correspondence address: „AGRAF” - Kieszkowski Rafał, ul. Strażacka 6, 05-084 Leszno, Poland.
2. The Seller recommends that the Promotion Participant provides in the complaint description: (i) information and circumstances concerning the subject of the complaint; (ii) the Participant's request related to the complaint; and (iii) the contact details of the complainant – this will facilitate and speed up the processing of the complaint by the Seller. The requirements given in the preceding sentence are only a recommendation and do not affect the effectiveness of complaints submitted without following this recommendation.
3. Complaints will be processed by the Seller within 14 days from the date of receipt of the complaint.
4. The Promotion Participant will be notified of the outcome of the complaint by a return message, which will be sent to them, depending on the form of complaint chosen by the Promotion Participant, in writing or to the email address from which it was submitted.
5. Sending or returning the Product as part of the complaint may take place to the following address: "Mexen, Sochaczewska 96B, P3 Logistic Parks, Hala 17, 05-870 Błonie-Wieś, Poland".
6. According to article 14, paragraph. 1-2 of Regulation of the European Parliament and of the Council (EU) No 524/2013 from 21 May 2013, we commit ourselves to placing information on the ODR platform. Online Dispute Resolution is intended to facilitate an independent, non-judicial settlement of disputes between consumers and traders through the Internet. These disputes relate to contractual obligations arising from online sales or service contracts concluded between consumers living in the Union and traders established in the Union.
7. The Consumer who would like to take advantage of the possibility of an amicable resolution to disputes concerning online purchases may submit a complaint, for example, via the EU's Internet ODR platform which is available at: https://ec.europa.eu/consumers/odr/.
8. For consumers in Ireland, further information on consumer rights and dispute resolution can be obtained from the Competition and Consumer Protection Commission (CCPC) at www.ccpc.ie. These Terms and Conditions do not affect your statutory rights under Irish consumer protection law, including but not limited to the Consumer Rights Act 2022.

§ 4 Protection of Personal Data

1. The Organiser collects and processes the personal information of the Customers in accordance with applicable provisions of law and with the Privacy Policy.
2. Additional explanations regarding the protection of personal data are contained in the “Privacy Policy” available during the Promotion Period on the website www.mexen.ie.

§ 5 Right to Withdraw from the Agreement

1. In the event that the Promotion Participant, being a consumer, purchases a Product as part of the Promotion in the Mexen online store, they have the right to withdraw from the sales agreement within 14 days from the date of receipt of the package without any reason. To meet the aforementioned deadline, it is sufficient for the Promotion Participant to submit a declaration of withdrawal from the sales agreement. Issues related to withdrawal from a distance contract are regulated in the online store's terms and conditions and in the section available at: https://mexen.ie/returns, subject to the conditions below.
2. Partial or complete withdrawal by the Promotion Participant from a distance sales agreement concluded under the Promotion may result in the loss of Discounts granted to the Promotion Participant for participating in the Promotion.
3. In the event of partial withdrawal from a sales agreement concluded under the Promotion, if the number of products remaining with the Promotion Participant is less than required to grant a specific Discount (in accordance with Section II, point 2), the Participant loses the right to the Discount. In such a situation, the Seller will re-calculate the price of the products remaining with the Customer according to the regular prices on the day of purchase, and the amount to be refunded for the returned products will be reduced by the difference resulting from the loss of the Discount.
4. This chapter does not apply to entrepreneurs.

§ 6 Amendment of the Terms and Conditions

1. The Seller reserves the right to amend these Terms and Conditions for a valid reason, which includes, among others:
   1. the necessity to adapt technical and IT solutions for the organisation of the Promotion to market conditions related to technical and IT progress.
   2. a change in existing or the introduction of new generally applicable legal provisions that directly affect the content of these Terms and Conditions.
   3. the issuance of an administrative decision or court ruling necessitating a change to these Terms and Conditions.
   4. the correction of obvious typographical errors.
2. Introduced changes to these Terms and Conditions will not affect rights acquired by Promotion Participants. Changes to these Terms and Conditions will be published one day in advance. Promotion Participants who do not accept the provisions of the new Terms and Conditions may withdraw from participation in the Promotion.

§ 7 Final Provisions

1. Participation in the Promotion means acceptance of these Terms and Conditions.
2. In matters not regulated by these Terms and Conditions, the provisions of the Mexen online store's terms and conditions and applicable Irish law, including the Consumer Rights Act 2022, and EU law shall apply.
3. These Terms and Conditions are valid during the Promotion Period, as specified in Section I, point 4.
4. Please note that we only provide our Site for domestic and private use. You agree not to use our Site for any commercial or business purposes, and we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity. To the extent permitted by law, we exclude all conditions, warranties, representations or other terms which may apply to our Site or any content on it, whether express or implied.
5. We will not be liable for any loss or damage caused by a virus, distributed denial-of-service attack, or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of our Site or to your downloading of any content on it, or on any website linked to it.
6. Nothing in these Terms and Conditions excludes or limits our liability for death or personal injury arising from our negligence, or our fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by Irish law.
